Can foreigners buy property in Malaysia?

Yes, foreigners can buy property in Malaysia, but there are some restrictions.

Foreigners cannot buy certain types of properties, including properties built on Malay reserved land, low-cost or medium-cost affordable units, and properties allocated to Bumiputera groups. There is also a minimum purchase price depending on the state and whether the foreigner qualifies for the MM2H visa program.

  • You may be subject to additional taxes or levies on property purchases. 

  • There may be limitation on rights to sell or rent out your property.

What are the tax implications for overseas Malaysians investing in Malaysian property? 

If you're a Malaysian living overseas and earning rental income from your Malaysian property, you'll still need to pay taxes in Malaysia.

 

  • If you're considered a Malaysian tax resident, your rental income is added to your total income and taxed at the progressive rates (0% to 30%). You may also be eligible for certain tax reliefs. 

  • If you're a non-resident, a flat 30% tax is applied to your gross rental income. Unfortunately, you won't qualify for any tax reliefs.
